The Court of Appeal Abuja, on Friday, set aside the judgement of the Osun State governorship tribunal and declared Ademola Adeleke as the winner of the July 16 gubernatorial election in the state.
Delivering judgement in the appeal filed by Governor Adeleke on Friday, a three-member panel led by Justice Mohammed Shuaibu held that the tribunal erred when it ruled that the 1st and 2nd respondents (Oyetola and the All Progressives Congress (APC) proved their allegation of over-voting in the governorship election.
The tribunal, in January 2023, held that Oyetola was able to prove that there was over-voting in some of the polling units.

Consequently, the majority judgement of the tribunal ordered INEC to withdraw the Certificate of Return issued to Adeleke and issue a new one to Oyetola as the duly elected governor of Osun State.
While ruling on the issue of jurisdiction, the Court of Appeal resolved in favour of Adeleke stating that according to section 285(8) of the constitution as amended, the court has every right to entertain the appeal.
The court also awarded N500,000 against Oyetola and the APC.
