The Federal High Court in Kaduna has dismissed the suit filed by former Northern CAN Chairman, Rev. Yakubu Pam, and ex-Secretary Elder Sunday Oibe, challenging the election of Rev. Joseph John Hayab as chairman of the Northern chapter of the Christian Association of Nigeria (CAN).
Delivering judgment on Thursday, Justice H. Buhari ruled that the entity named in the suit—Northern CAN—is not legally recognized as a juristic person and, therefore, lacks the capacity to sue or be sued.
Only registered, incorporated bodies can initiate or defend legal actions under Nigerian law.
Counsel to the 2nd Defendant, Dr. Grace E. Kaka, explained that the ruling confirms unincorporated associations cannot bring lawsuits in their organizational names.
She added that the judgment validates the leadership of Rev. Hayab, who was properly elected on 25 February 2025, and resolves the ongoing leadership dispute as an internal matter.
In a separate statement, Rev. Hayab condemned rising insecurity in the region, citing recent attacks in Kwara, Borno, and Kebbi states.
Highlighting the killing of worshippers, abductions, and the death of a senior military officer, he expressed solidarity with victims and called for intensified military operations to restore peace.
Rev. Hayab urged security agencies to remain resolute and condemned acts aimed at destabilizing communities, emphasizing prayers for the safe return of abducted persons and comfort for grieving families.
