Court stops FG from evicting AU from seven Ikoyi property

Justice O. Ogunjobi of Lagos High Court has restrained the Federal Government from evicting the African Union (AU) from the seven property located in Ikoyi area of Lagos occupied by it.

The judge granted the interim restraining order on Wednesday following the granting of an ex-parte motion filed and moved by the African Union through its lawyer, Mofesomo Tayo-Oyetibo.

The seven property involved were situated at 3 Macpherson Avenue, 5A Ikoyi Avenue, 5B Ikoyi Avenue, 24 Mekuwen Street, 20 Gerard Road, 2A Kuramo Close and 2B Kuramo Close.

In granting the motion, the judge restrained the Federal Government from interfering with the claimant’s occupation and use of the property whether by an executive, administrative, judicial or legislative action.

The AGF and the Presidential Implementation Committee of the White Paper on the Commission of Inquiry into the Alienation of Federal Government Landed Property are the first and second defendants in the suit marked LD/S591GCM/2022.

The claimant asserted via its originating summons that under several Deeds of Indenture relating to the property, it is entitled to quiet enjoyment and exclusive possession of the seven property.

It averred that it had to approach the court because efforts are being made to evict it from the property despite being in their possession.

AU further prayed the court to make an order of interim injunction restraining the defendants pending the determination of the notice of motion for interlocutory injunction.

Further hearing in the suit has been adjourned to April 8 for report of service.
