Court bars Mamuda Beverages over Fearless drink trademark dispute

A Federal High Court sitting in Abuja has restrained Mamuda Beverages Nigeria Limited from continuing to produce its “Pop Power” energy drink, after Rite Foods Limited alleged the product infringes on the trademark of its Fearless Energy Drink brand.

Justice Binta Nyako, in a ruling granting an interim injunction, found that the packaging of Pop Power bears a striking resemblance to the Fearless brand and ordered an immediate halt to production pending the determination of the substantive suit.

The court also dismissed a preliminary objection raised by Mamuda, holding that a redesigned version of the product still closely mirrors Rite Foods’ established brand identity.

Under the terms of the order, a court-supervised inventory of existing Pop Power products will be compiled, though stocks already manufactured may continue to be distributed.

The injunction will remain in force until the end of the year or until the suit is finally decided. The matter was adjourned to September 23 for further hearing.

The dispute traces back to a suit filed by Rite Foods in January 2025, in which the company accused Mamuda of producing a lookalike product in violation of an earlier out-of-court settlement that had required Mamuda to modify its product design and refrain from trademark breaches.
